1. Introduction
Welcome to WanderFieldSky ("us," "we," or "our"). These Terms & Conditions ("Terms") are applicable to your use of our yacht charter and website services at wanderfieldsky.sbs, both of which are managed by WanderFieldSky.
Your reservation of a charter or use of our Service constitutes your consent to these Terms. Should you not agree with any section of these terms, you should refrain from accessing the Service.
2. Service Overview
WanderFieldSky offers a selection of first-class yacht charter services including, but not limited to:
- Yacht rentals for the day
- Voyages at dusk
- Corporate getaways
- Functions for private gatherings
- Extended charters over several days
Our services are contingent on vessel availability and meteorological conditions. We may alter or halt any services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter reservations require you to:
- Have attained at least 18 years old
- Provide valid and thorough information
- Remit the needed deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed upon the successful processing of your payment and our issuance of a written confirmation. We retain the discretion to decline service to anyone.
3.3 Availability
Charter acceptances are dependent on the availability of a vessel and favorable weather conditions. We commit to good faith efforts to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All pricing is provided in € and is inclusive of relevant taxes unless stated otherwise. Prices are liable to alterations without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter price due at the time of booking
- Final payment: To be completed 48 hours before the departure of the charter
- Extra expenses (where applicable): Payable after the charter's conclusion
4.3 Payment Methods
We accept most major credit cards, bank wire transfers, and certified cheques. All payments are processed using secure, encoded technologies.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours before the departure, a full refund minus service fees
- Between 24 to 72 hours before departure, a refund of 50% is provided
- Less than 24 hours prior to departure, refunds are not available
5.2 Weather Cancellations
Should the captain deem weather conditions as unsuitable for safe travel, we will propose to either:
- Reschedule the charter to an alternative date without any extra charges
- Provide a complete refund if rescheduling is unachievable
5.3 Mechanical Issues
In the case of mechanical failure with the assigned vessel, we will endeavor to supply a comparable alternative. If an alternative is not procurable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all directions from the crew members
- Use any provided safety gear when required
- Disclose any health conditions that could affect their onboard safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
The following items are forbidden onboard:
- Containers made of glass
- Illegal substances
- Firearms or any variety of weapon
- Non-alcoholic beverages in excess (beyond reasonable quantities for personal consumption)
- Pets, except in cases of prior approval
6.3 Conduct
Guests are required to behave in a respectable and orderly fashion. Any passenger conduct that endangers safety or disrupts the charter for others may result in early termination of the service without reimbursement.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the charter costs paid by you. We are exempt from accountability for:
- Injuries arising from passengers' own neglect
- Damage to or loss of personal belongings
- Any form of indirect, consequential, or punitive damages
- Delays caused by weather or other conditions outside our control
7.2 Insurance Coverage
We uphold comprehensive marine insurance for our vessels and operations. It is the passengers' responsibility to have their personal and travel insurance.
7.3 Assumption of Risk
By opting into our charter services, you recognize the inherent risks associated with marine activities and accept personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, routes, or schedules as necessitated by weather conditions, safety concerns, or operational needs. We shall strive to offer similar alternative experiences wherever possible.
9. Force Majeure
We hold no liability for postponements, cancellations, or alterations brought about by factors beyond our control, inclusive of but not limited to:
- Severe meteorological events
- Natural catastrophes
- Regulatory mandates
- Port shutdowns
- Unplanned mechanical breakdowns
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. The use of our services implies agreement to our data collection and utilization practices as outlined in our Privacy Policy.
11. Intellectual Property
The content on our website, including texts, graphics, logos, and imagery, is safeguarded by copyright and trademark laws. Replication, dissemination, or the creation of derivative works is not authorized without our explicit written consent.
12. Governing Law
These Terms are subject to the laws of Monaco and any disputes will be adjudicated in courts situated in Monaco, Monaco.
13. Changes to Terms
We hold the right to amend these Terms when necessary. Any changes will be published on our website, accompanied by an updated revision date. Continued engagement with our services signifies acceptance of any revised terms.
